A SPORTSMAN stripped of his shotgun certificate after his ex-wife accused him of domestic violence was not given a fair hearing, top judges have ruled.

Antony Crispin Mason, 49, of Kings Somborne, is "a respected member of the shooting community", London's High Court was told today (Friday).

But, in December 2016, Hampshire police decided to revoke the firearm and shotgun certificates he had held for many years.

That followed accusations from his ex-wife, Aundria Mason, that he had been violent towards her prior to their divorce.

The police had also received complaints from one of Mr Mason's neighbours, Judy Venables, said Mr Justice Jeremy Baker.

She complained that Mr Mason had been "verbally aggressive" towards her in the midst of "a dispute over dog walking".

Mr Mason vehemently denies both women's claims and challenged the revocation of his certificates at Winchester Crown Court last year.

But Judge Douglas Field dismissed his appeal, describing him as "a danger to the public safety and the peace".

Mr Mason's barrister, Richard Onslow, argued at the High Court that Judge Field had cut him short, denying him a fair opportunity to put his case.

Mr Mason had "always sought to act responsibly, sensibly and securely in relation to his firearms and shotguns," the court heard.

And, save for a drink driving conviction when he was aged 18, he was of entirely good character.

Overturning Judge Field's decision, Mr Justice Baker agreed that Mr Mason had not been given a fair hearing.

He had not received "a proper opportunity of correcting or contradicting the case against him".

The ruling means that Mr Mason can appeal to the Crown Court afresh against the revocation of his certificates.

Mr Justice Baker, who was sitting with Lord Justice Irwin, observed: "This court has not of course considered the underlying merits of Mr Mason's appeal, beyond the fair trial issues raised before us.

"He should be under no illusion that, on the re-hearing of the appeal, the crown court will necessarily determine the appeal in his favour."
