A DRINK-DRIVER has received a suspended prison sentence and a three-year driving ban after refusing to provide a breath specimen.
Dean Millins, 44, of no fixed abode, appeared at Basingstoke Magistrates’ Court for sentence on Thursday, April 24. He had previously pleaded guilty, on November 19, 2025, to failing, without reasonable excuse, to provide a specimen of breath for analysis when suspected of drink-driving in Andover on July 28, 2025.
The court heard that Millins was required to give a breath sample on approved equipment as part of an investigation into whether he had committed a drink-driving offence under the Road Traffic Act, but refused to do so.

Failing to provide a specimen when lawfully required is treated as a serious offence in its own right.
Magistrates said the offence was so serious that only a custodial sentence could be justified and imposed an eight-week prison term, suspended for 12 months.
The suspended sentence was made without additional community requirements attached.
Millins was also disqualified from driving for 36 months, with the ban backdated to an interim disqualification imposed in January 2025.
His guilty plea was formally taken into account when sentence was passed.
