Council safety fears see pedlars moved from prime location (From Andover Advertiser)

complaints from WestQuay shopping centre managerment, they have complained before, they do not like any one selling having demos rallys out side there doors

About time too. Nothing but tat, suspect quality and dodgy 'food' everywhere.
Add in the chavs, trophy dogs and low-life, it's no wonder most people avoid the precinct like the plague.
Surprised the shops paying high street rates haven't kicked up sooner.

That explains why the hot dog man has been playing his radio extra loud and singing at the top of his voice for the last 2 weeks.
What is happening around the Bargate, outside Burger King there are another 3 burger vans, it's a joke , how many do we need.
Give me hot peas anyday.

No great loss. They should be moved, it gets very busy outside those doors and it is tat! Paying £12.50 for a licence is a bargain but they can't expect to block up a prime area for that....... I doubt Westquay is at all bothered by any 'competition' from these sellers, it's another market!

First of all, it's a disgrace that they only gave them one week to let them know their livelihood was about to end.

It's downright disgusting that they are telling them that it is going to end just a few days before Christmas.

If they were really worried about the space taken up, they wouldn't allow the Christmas market to come every year and block up 50% of the precinct to sell tat and dodgy food during the busiest shopping time of the year.

If it was getting out of hand, then they should have made licenses renewable and refused to issue any additional ones. Only allowing the issue of a license to someone new when one had been relinquished.

I'm going to miss the hot dog seller. Whenever I've had to queue, he has given me a 30% discount on my hotdog, and all in all a nice, if slightly eccentric, guy. He was part of the character of Southampton, that the council obviously wants to destroy.

I hope they take the council to court, and I hope they win.

Their livelihood isn't about to end, only their licence to operate in the specified area. Cashing in on the Chrismas crowds is their reason for swamping the precinct, with no regard to the shops that occupy all year around and pay accordingly.
Maybe the hot dog seller will give you his forwarding address.

I looked into this recently for anothrr reason. I assumed that they were classed as 'street traders' and noted at the time that apart from newspaper and flower sellers street traders are banned from the precinct.
Now I know about pedlars licences...well maybe my business idea can get off the ground....

I do wish people would read things properly. One it isn't the council who issues them with a licence, it's the police....

and if they are supposed to 'move' every 20 minutes then they are clearly abusing the terms of those licences by not moving. The traders (including street traders who DO have a council licence) and those shops who pay business rates have every right to complain if they are being a pain blocking up the pavements, blocking views into shops and increasing numbers. Whilst these sellers have not good the huge overheads that other businesses, even small businesses have.

The Council have every right to protect the streets from an overflow of these people. That hot dog seller may have a street traders licence and not pedlars, I'm imagining so as he's selling food? He would also have to have a Food Safety certificate.... it says nothing in the article about him being moved!

These people make our town centre look like a dump. They pay no business rates or taxes. They actually fail to use their victorian pedlars licence as requested. These people should actually NEVER stop moving unless someone stops them to browse. Councils up and down the country are all doing the same to get rid of this menace. There is nothing stopping these people having a stall on the wednesday market. But of course it will cost more than £12 annually ! The Police have actually failed in their duty giving out these victorian licences for them to be abused. There are many shops in the High stree that sell phone covers and hats that pay their taxes and rates.

As for the oddball that sells dirty hotdogs. How was that ever allowed, when other food sellers require a food licence ?

This is one step in the right direction, Next step, ban smoking outside West Quay doors and that will make life easier for everybody whilst shopping.

Oh and the Charity clip board pests.

Hoo-ray. About time too. No way should anybody be allowed to play loud music in the high street. EVER. That includes the slush puppy seller with his stall as well!. Sick and tired of the hotdog man and his overloud radio and the buskers with their amplifiers - all year.

Think of it this way. My son is badly affected by loud music. The noise makes him physically ill. Why shouldn't he be allowed to go shopping in his own City centre?

I think they should have been given more notice.

As for the Christmas market - it has become less and less German and more and more local tat every year.

Seen them there all year ( a few) but why are the shops feeling threatened?
I lived in Thailand & on every pavement you find stalls selling everything but instead of driving trade away from the shopping Malls they attract custom .
the shoppers stop look at the stalls then go into the Malls so boosting trade for the Malls.
If the Council were asked to do this I'll give credit where credit's deserved well done for acting so promptly but is it fair on these sellers?
Could you not find them another pitch to make both groups happy?

I don't care whether they are there or not BUT if the hotdog seller isn't there his extra loud "music" won't be either!. Keep the traders, ban the music or just get shot of the lot.

It can be a nightmare trying to walk past without bumping into someone who is far too busy looking at Facebook on their mobile.

It just becomes one big stand still on busy days.
I find shopping stressful as it is, so to have these annoyances just makes me avoid the Centre of town.

This is a joke
The Council lacks the powers and the man power to remove pedlars.
To prove that they are not moving around to sell goods takes hours of observation on CCTV
Then a whole operation is needed involving Council staff and the Police to physically remove them, take possesion of their stall and goods and for the Police to report them for summons for illegal street trading.
The addresses on the pedlars certificate are normally 'mickey mouse'.
Someone has to then store the stall and goods for a court appearance for which most of the 'pedlars' do not turn up leaving the Council to make application to the Court to dispose of the seized goods.this is normally 10 to 12 months later.
Worse, the pedlars re-appear on the Pricinct the following day with a new stall and goods supplied by Mr Big who is behind all the pedlars and reaping the profits from their sales.

Wrong West Quay have all ways been like that and if go there those stalls are located where the road use to be and not on the pavement use to be, they tried to get the Socialist Party stall removed a few times, who sets up in the center, but they can't because of the law allows them to set up a stall so long it as there news paper, the SP are licence to be able to sale papers out up a stall on any public ground in England and Wales

It can be a nightmare trying to walk past without bumping into someone who is far too busy looking at Facebook on their mobile.

It just becomes one big stand still on busy days.
I find shopping stressful as it is, so to have these annoyances just makes me avoid the Centre of town.

They are placed where the road use to be and not on the pavement, for them to be on the old pavement area then they must ask permission from the shop and the council.
The street Traders licence is a very old law of the land go's a number of hundreds of years, to refuse a street traders licence you got to have a very good reason, the 20 mins rule can only apply if there is an obstuction to horse and cart, now days traffic.

i couldnt be more delighted the stalls are a safety hazard blocking the paths not to mention a fire hazard with all those 100% pure polyester pashminas . and the hot dog man is a total pest with his music , i once asked him to turn his music down as we were sat out side pret trying to hgave a quiet coffee and his loud response brought all of the precinct to a standstill as he leapt up and down shouting about jesus ...some body called the cops and he was cautioned . also it is pretty well known that one or two of the mobile phone sellers are claim benefits and wages ...just sayin

Get rid of the seating areas outside shops too.That takes up space on the precinct & encourages flying vermin as tables are not cleaned quickly either !!!

I can understand the Council's view as there appears to be increasing number of them appearing outside West Quay.

I bought a nice mobile phone cover off one of them when I couldn't wait for one from ebay - so they do come in handy now and then.

national law over rules local law, when local law over rules national law it can only last for so long and as to be renewed every so often, the Act 1976 and 1982 as not been renewed and is out of date so it reverted back to the old law, 20 mins for a street trader if he will cause an obstruction to taffic, and the require min distance is one lenght of the stall or barrow.

Wrong again you know very little about politics it seems, its what they stand for all ways have done, to fight any government that wants to do harm to the majority of the public, (thats because the Socialist Party is 99% made up from the ordinary people off the streets) the selling of nationalise and public services or making cuts and closing them down have all ways been a case that they will fight to keep them for the public, and in a some other cases people caome to the Socialist Party for there help.

From my point they block the walking area. Outside West Quay doors you have a congregation of smokers, push chair brigade, Charity sellers etc.

It can be a nightmare trying to walk past without bumping into someone who is far too busy looking at Facebook on their mobile.

The street Traders licence is a very old law of the land go's a number of hundreds of years, to refuse a street traders licence you got to have a very good reason, the 20 mins rule can only apply if there is an obstuction to horse and cart, now days traffic.

Hooray for the establishment! but all you others need to know that the people who were trading in a fixed position were not Pedlars, they were either licensed Street Traders or unlicensed Street Traders. The Local Authority have redress through the courts against unlicensed Street Traders. Obtaining a Pedlars Certicate from the Police allows a Pedlar to trade on foot whilst moving, stopping only to make or conclude a sale. If persons holding a Pedlars Certificate were not operating as Pedlars and they were selling, then they were operating as unlicensed Street Traders.

It is the unlicensed Street Traders that are giving the genuine Pedlars (operating under the conditions of their certificates) a bad name.

So you don't like Charity collectors or Big Issue sellers well, charity collections are allowed to operate by permission of the Local Authority the charities just have to apply for a set date, Big Issue sellers do not need permission of any kind nor do stationery people who look like statues (or actors or buskers).

The Local Authority will determine whether streets are consent streets or prohibited streets for the purposes of street trading, then they will issue (issue means sell) licenses for fixed trading positions and those fixed trading positions will be outside the very shops they were outside before.

QUESTION So what will you have gained Answer NOTHING, you will still have Big Issues being sold and charity collections and fixed stalls that will be licensed by the Local Authority.

TAT, yes Tat, well it depends on your circumstances, one man's tat is another man's treasure.

Take into account the proliferation of charity shops, pound shops and 99p stores. The city centres are dying because city centre managers want to give you a unique experience.

What is that unique experience? they have all joined together to make sure their town centre is exactly like everyone else's town centre, uniform, full of the same shops all selling the same thing. The same range of goods.

Life is so boring that most of you shop on the internet looking for something new and can't be bothered to go to the supermarket so order on line. What puts you off? is it the town centre uniformity, traveling, cost of petrol, car parking, traffic wardens, illegal wheel clamping? YES! so that much so, you cannot be bothered to select your own sprouts for Christmas lunch.

What about Tat and the CE mark, all goods sold new in the UK come complete with CE mark, so that the Tat is certified as being in conformance with the CE Tat regulations which could be called EuroTat, (I will have to check that.)

What about second hand Tat? Second hand Tat can be found in charity shops, these can be found where actual "unique shops" have gone out of business and the owner of the premises has allowed a Charity shop to set up, because charity shops do not pay business rates and nor does the owner of the premises occupied by a charity shop.

You can even find your next Tat on the internet, you will not need reminding about Ebay where you can all get rid of the Tat you were given as Christmas presents this year. Or you can recycle Tat.

GERMAN MARKET. Have you ever been to a real German Market at Christmas? Well I have, it was in Frankfurt, there was no shortage of stalls and the market was very busy.

This made me think! If the German Markets are still in Germany were do the German markets that sprout up for 6 weeks at Christmas in the UK come from and why should they decide to come many other European and UK cities.

Where do German markets go after Christmas? It must really be profitable for them to get in their VW vans and bring their food and EuroTat to Southampton and Birmingham etc.

How can they just set up their stalls in the best places? Well it's like this YOUR Local Authority issue (I mean they sell) Temporary Licenses for fixed trading stalls and the Germans become 'Temporary Street Traders' in the best areas, and to do that in the nicest possible way YOUR Local Authority forced all your local traders off the street.

I don't think that it is anything to do with the war when the unified UK managed to prevent the German markets from appearing in every city, town and village.

We succeeded then why not now? Well, now all our UK laws are superceded by EU laws and EU laws seem to say, we don't care what the UK have done before but now you have to do it the EU way and make the UK fully open to all EU businesses.
